These terms apply when you use www.orcasail.com, and when you book a service or use a gift card, booking credit or offer code on it. “We”, “us” and “Orca” mean Orca Corporate Services Private Limited. “You” means the person who uses the site or makes the booking.
2. Words used in these terms
- Boat owner: the person or company that owns or manages the boat and provides its crew.
- Ride/Sail: your time on board.
- Time slot: the date, start time and end time of your ride.
- Price: the price per ride shown on the boat page. GST at 18% is added to it.
- Booking amount: the part of the price you pay to hold your time slot on a boat category that you chose.
- Balance: the rest of the costs to complete the experience.
- Gift card: an Orca gift card, used at checkout with its code.
- Booking credit: a credit we give you in the cases set out in section 10, used at checkout with its code.
3. Accepting these terms
When you book, create an account, or use a gift card, ride credit or discount code on the site, you accept these terms. You also accept the Booking, Cancellation and Weather policy and, when you use a gift card, the Gift Card terms. You confirm this with a tick box at checkout.
Our Privacy Policy explains how we handle your personal data. Our Cookie Policy explains the cookies the site uses.
Some boats or offers carry extra conditions. When they do, the boat page or the offer shows them.
4. Changes to these terms
We may update these terms. The date at the top shows when they last changed. Your booking follows the terms that were on the site on the day you booked.
5. Our role
Orca Sail brings boats from different owners together in one place.
We check each boat and its owner before we list it. We take your payment through a secure payment gateway. We look after you from booking to boarding, and we are your point of contact if anything goes wrong.
The ride itself is provided by the boat owner and the crew. For a partner’s boat, we collect the price on the owner’s behalf and pay the owner.
After you book, we will give you the boat owner’s business name, address and contact number if you ask for them.
6. How boats are shown
You can browse boats by city and by category. You can narrow the list by category, boat type and number of guests.
[How the list is ordered, and whether any boat is given a higher place, for example Orca’s own boats: to confirm with the developer and Orca.]
7. What you are booking
- A time slot on the boat shown, or on a boat of the same class or better (see section 10), for up to the number of guests shown on the boat page.
- The price is per ride, not per person.
- Most rides are two hours. Some boats have a different ride length, and the boat page shows it.
- Mumbai sails from 7 October to 20 May. Goa sails all year in fair weather. The Mumbai jetty closes at 9pm.
8. Prices and payment
- Prices are in Indian rupees, per ride, plus 18% GST. You see the full amount, with GST, before you pay.
- We do not add a convenience fee or a booking fee.
- You can pay by UPI, credit or debit card, or internet banking. Payments are taken by Razorpay, our payment gateway, on its secure checkout. We never see or store your card, UPI or bank login details.
- Companies can enter their registered name and GSTIN at checkout to receive a GST invoice.
- Add-ons, such as cake, food and decorations, are priced separately and paid in advance.
9. Booking amount, balance and cancellation
This is the short version. The full rules are on the Booking, Cancellation and Weather page.
- You hold your time slot by paying the booking amount: ₹999 for a boat that carries up to 12 guests, 10% of the ride for 13 to 21 guests, and 20% for 22 or more.
- The balance is due 4 days (96 hours) before your sail. If you book less than 4 days ahead, you pay in full.
- You can change your date free of charge up to 4 days before your sail, up to 2 times.
- If you cancel 4 days or more before your sail, we keep the booking amount and refund the rest. If you cancel less than 4 days before, or do not arrive, there is no refund.
- If the weather, the sea or the authorities stop your ride, you choose a new date at no charge or a full refund.
- If we or the boat owner call off your ride for a reason within our control, you choose a new date at no charge or a full refund. You also get a ride credit equal to your booking amount (see section 10).
10. If your boat cannot sail
We do our best to give you the boat you chose. Sometimes that boat cannot sail, because of a breakdown, a crew issue or another operational reason. We then offer you a boat of the same class or better, in the same time slot, and we tell you before your sail. If you take it, your ride goes ahead as booked. If you would rather not take it, you can choose a new date at no charge or a full refund.
If we cannot offer you a boat of the same class or better in your time slot, or we or the boat owner call off your ride for any other reason within our control:
- you choose a new date at no charge or a full refund, with nothing deducted; and
- you also get a ride credit equal to the booking amount for your boat.
The ride credit:
- is sent to you by email as a code;
- can be used on any ride booked on www.orcasail.com within 12 months of the date we send it;
- is one credit for each booking we call off;
- cannot be exchanged for cash and cannot be resold.
There is no ride credit when the weather, the sea or the authorities stop the ride (see section 19), or when you choose not to take a boat of the same class or better that we offer in your time slot.
The photographs on the site show the boat class. They may not show the exact boat you get. Please read the note about photographs on each boat page.
11. Your responsibilities
- You must be 18 or older to book. The details you give us must be true and complete.
- If you create an account, keep your login to yourself. You are responsible for bookings made through it.
- The number of guests on your booking is the most the boat will carry. Every person on board counts, babies included. The crew will not sail with more people than the boat is allowed to carry.
- Give us one mobile number for your group. We use it for the briefing call the day before your sail and for weather updates.
- If you book for other people, please share these terms and the on-board rules with them.
12. On board
- The captain has final authority over the boat and everyone aboard. Please follow the crew’s instructions.
- Every guest listens and respects the safety briefing and directions by the crew on the deck. There is a life jacket for everyone. Check your size esp for for children if you have a specific fear and concern before sailing.
- Nobody needs to be able to swim. Nobody goes into the water.
- We recommend rides for children aged 5 and above. Babies travel in arms. Children stay with an adult at all times.
- Alcohol is not permitted on board as a rule. Some boat owners can arrange it, with the permission it needs and at a cost. Please ask us before you book. The captain can stop it at any time.
- Smoking is allowed only where the boat permits it, in the area the crew shows you.
- Food, cake and special decorations are arranged through us in advance and paid for before the sail. In Mumbai, outside food and decorations are not allowed. Do not throw flowers, religious items in plastic bags (use paper bags or cloth if you need to) in the sea directly. Ask the crew and they will assist you. This should ideally be done when away from the shores.
- Please arrive at the boarding point 10 to 15 minutes before your time slot. A late start does not extend your ride.
- Please look after your own belongings. Do not carry expensive items – jewellery, hand-bags. If you do, please store and keep them safe area so as not to lose them on the sea. We cant retrieve them for you.
13. Gift cards, ride credits and discount codes
Gift cards follow the Gift Card terms. Ride credits follow section 10. A discount code follows the conditions shown with it. None of them can be exchanged for cash.
14. What you may not do
You may not use the site to:
- make false bookings, or hold time slots you do not mean to use;
- resell rides, gift cards or booking credits without our written agreement;
- copy the site’s photographs, text or prices for your own use;
- break the law, or disrupt or damage the site.
15. If these terms are broken
We may cancel a booking or close an account if these terms are broken, or if the details given cannot be checked. The captain may end a ride early if a guest’s conduct puts anyone at risk. In either case, no refund is due.
16. Our content
The Orca name, logo, photographs and text on the site belong to Orca, or to the people who licensed them to us. Please do not copy them without our permission.
17. Messages we send you
We send messages you need for your booking by WhatsApp, SMS, call or email: your confirmation, payment links, balance reminders, the briefing call, weather updates and any ride credit. We send news and offers only if you have agreed to receive them, and you can stop them at any time.
18. Limits of our liability
- We take reasonable care to keep the information on the site accurate. Boat details come from the boat owners, and we check them before we list a boat.
- If something goes wrong with your ride, we take it up with the boat owner for you and keep you informed.
- Our total liability for any booking is limited to the amount you paid for that booking. We are not liable for indirect loss, such as missed events or travel costs.
- Nothing in these terms limits any right you have under Indian consumer law.
19. Events outside our control
We are not responsible for delays or cancellations caused by events outside our control. These include weather and sea conditions, closure of the port or harbour, orders from the authorities, strikes and public emergencies. When this happens, the weather and cancellation rules apply, and you choose a new date at no charge or a full refund. You can also ask for credit for future use.
20. Indemnity
If you break these terms or the law, and a claim against Orca or a boat owner results, you agree to cover the loss that follows.
21. If part of these terms cannot be enforced
The rest of the terms still apply.
22. Complaints and Grievance Officer
If something has gone wrong, please tell us on WhatsApp or by phone at +91 99302 12500, or write to sailing@orcasail.com. Please put “Grievance” in the subject line.
Grievance Officer, Orca Corporate Services Private Limited, Emgee Greens, MTV Road, Wadala (East), Mumbai 400037 · sailing@orcasail.com · +91 99302 12500. We give every complaint a reference number. We acknowledge it within 48 hours and resolve it within one month.
23. Law and courts
These terms are governed by the laws of India, and the courts at Mumbai have jurisdiction. This does not stop you from approaching a consumer commission under the Consumer Protection Act 2019.
